Alleging that he believed the criminal would once again fall for criminal offenses, a judge refused a lawyer’s request to release a suspect from prison and ordered that he should stay in custody until the oral trial.
In reference to what the newspaper Clarín published, the verdict was given by the Instruction Judge of Buenos Aires Juan María Ramos Padilla, who didn’t want to have to explain the relatives of a potential victim why he had a released an accused with 15 lawsuits.
“Judges have to look at things in a different way. We aren’t fulfilling the duty we have with society”, said the judge yesterday.
Eduardo Fernández has two criminal offenses against property, murder attempt, and resistance to authority. Last week he was busted when he tried to mug someone knife in hand. As attempt of robbery is considered a minor offense, it is non jailable (it has a minimum imprisonment of 20 months). That’s why, last Thursday, the official defender, requested Fernandez freedom, which was rejected by the judge.
